Rosanna Blanks and Daniel Richardson VS Samuel B. Caperton and Susan J. his wife and William A. Stephenson of Lawrence Co., TN and Joseph Blands of parts unknown.

Rosanna Stephenson, the mother of Rosanna Blanks and William A. Stephenson and grandmother of Daniel Richardson died about 22 May 1849. Said Rosannah Stephenson in her lifetime and about three years or more before her death, purchased from William A. Stephenson a tract of land containing 20 acres lying on the waters of Rutherford Creek being part of the land that William A. Stephenson then owned and upon which he resided. She paid $200 for the tract of land and was given a deed for it. She was about 80 years old and unable to take the deed to the Court to have it recorded, so she gave it to William A. for him to have it recorded for her. He failed to do it or to return it to her. After the purchase, Rosannah moved to the land and lived with her daughter, Rosanna Blanks and it was witnessed by Henry Foster and William Stephenson, a son of William A. Stephenson. William A. by arrangement with Caperton and his wife who were connected with him in 1851, swapped lands with Caperton of the whole tract upon which he resided including the 10 acres which was deeded to Rosannah. On 24 Nov. 1854 Caperton instituted a suit of ejection for the said 20 acres. John G. Stephenson, a brother of William A., was a tenant of Rosannah, said suit is still pending. They say William A. Stephenson is guilty of fraud by suppressing the two deed. Joseph Blanks is the husband of Rosannah Blanks but abandoned he many years ago and lives in parts unknown.

Deposition of Moses Caskey, 4 Sept 1856 - I carried the chain to survey the (30?) acre tract of land in despute in 1846 and was a witness to the deed from William A. Stephenson to Rosannah Stephenson. Mrs. Rosannah Stephenson occupied the tract of land at the time it was surveyed and until her death. Since her death it has been occupied by Rosannah Blanks and Daniel Richardson and has been claimed by them. I purchased a tract of land from William A. Stephenson and surveyed it the same day as the 30 acre tract. Mrs. Blanks and Mr. Richardson left the place after the death of Mrs. Richardson but do not remember the time. William A. told me Mrs. Blanks and Mr. Richardson claimed the land.

Deposition of William H. Childress - Mrs. Blanks is my Aunt and Daniel Richardson is my cousin. I think Mrs. Rosanna Stephenson died in May 1849 and in the fall or winter Mrs. Blanks and Mr. Richardson moved off the place. I do not know who took possession of it but I rented part of it from Mr. Richardson that winter. The balance of the land was cultivated by John G. Stephenson and Mrs. Blanks who moved on it in the spring of 1850. I was at the house the morning Mrs. Stephenson died and heard her complaining that the deeds had not been registered for the land. After her death, the land was claimed by Mrs. Blanks and Mr. Richardson. I got $300 from the proceeds of a tract of land that Rosanna Stephenson sold to Mrs. Patterson or McLemore. $200 was to have been paid for the land and the other $100 was by the request of the old lady on her death bed, to be divided between William A. Stephenson and my mother. William A. Stephenson has frequently told me since the death of Mrs. Stephenson that he would pay the share coming to my mother but has failed to do so.

Deposition of J.H.M.C. Blair, Aug. 1856 - I surveyd the land in dispute. I understood from Mr. William A. Stephenson that Mrs. Rosanna Stephenson was to have the 20 acre tract for the place she formerly owned near Mr. McLemore's. I understood she had an interest in the McLemore tract. She had lived on the place from my earliest recollect and I suppose she owned it.

Deposition of James G. Stevenson - Rosanna Stephenson purchased the tract of land now owned by McLemore and lived there a great many years. I built the house for her and fixed it up before I left her. I don't remember when she sold it to a Mrs. Patterson for something over $300 and loaned it to brother William A. Stephenson. I talked to both of them about the transaction. The interest on the money was to be paid in sugar, coffee and other groceries for her use. She was about 74 years old when she died. The last year or two before she died she was not able to get about of account of being a cripple and brother William A. Stephenson attended to her business for her. She purchased the 20 acre tract that she lived on at the time of her death. I saw a note to her from William A. with a credit of $200 for the land. There was a $215 balance due on the note. William A. Stephenson was the Admr. of her estate and he got possession of the note as Admr. I believe the balances was never collected. Rosanna Stephenson requested that $50 be paid to Fanny Childress, her oldest daughter and $50 to William A. Stephenson. I have been informed that Mrs. Childress never received it. I understood from Rosanna Stephenson and Willam A. that the 20 acre tract was given to Rosanna Blanks and Daniel Richardson as a deed of gift. I understood that William A. sold the original tract including the 20 acres to Samuel B. Caperton. Rosanna Stephenson was the mother of William A., Rosanna Blanks, and myself. William A. told her to sell out and he would sell her the tract of land for $9 an acre. He sent the wagon to move her but then charged her $10 an acre. I think his purpose in getting her near him was not to take care of her but to get the proceeds of her land. I think she moved to the 20 acre in 1845 or 1846. I understood that Mrs. Blanks and Mr. Richardson were absent for the time of the death of Mrs. Stephenson. William A. purchased his tract of land from Samuel B. Lee and resided on it. Daniel Richardson rented his part of the land to Childress and the part occupied by Rosanna Blanks was cultivated by her brother Grafton Stephenson with whom she lived.

Deposition of Benjamin C. Stephenson - I saw the note executed by William A. to Rosanna Stephenson for $325 in 1849 with a credit of $200 for the 20 acre tract of land. I understood that William A. is insolvent.

Deposition of Gilford Dudley - I heard William A. Stephenson at County Court when he qualified as Admr. and he seemed disposed to tell the worth of the estate. I was called on to give the value of her estate and proceeded to list the 20 acre tract of land. William A. stopped me and said she had transferred the land by deed of gift to Rosanna Blanks and Daniel Richardson and had left the management of it to him so they would not be cheated out of it. I reside about one mile from Mrs. Blanks and Mr. Richardson and have lived here 17 or 18 years. After Mrs. Stephenson sold the place near McLemore, she lived for a time in a house in the corner place near McLemore, she lived for a time in a house in the corner of William A.'s yard. I understood Mrs. Stephenson to say on her death bed that she did not owe a dollar in the world and that she received a pension from the Government. I don't know how much she received and she made some money by acting as midwife for the neighborhood. She was always a prudent economical old lady.

Deposition of Thomas A. Crow, Esqr - I was Revenue Commisioner in 1849 and 1850 on the land was listed for taxes in the name of Mrs. Rosanna Stephenson.

Deposition of John Grafton Stephenson - I was present the morning after the death of Mrs. Stephenson and saw William A. receive the two deeds in question and $25 in money to register the deeds and a note of $125. Rosanna Stephenson purchased the 20 acre tract of land while living at my house and then moved upon it. I was present when purchase was made. The trade was made for 30 acres originally but after she moved on it, it was changed to 20 acres. She owned part of the McLemore tract but sold it and loaned the money to brother William A. Stephenson. I think she sold it to Mrs. Patterson at the instance of William A. and the 20 acres was paid for out of the money she loaned brother William A. In 1849 and 1850, I lived on a portion of the McLemore tract of land given to me by Mrs. Rosanna Stephenson which is about 4 miles from William A. In 1849 and 1850 William A. lived on a place he sold to Caperton and from which the 20 acre tract was taken. I was present when William A. received the money that he borrowed from his mother.

Deposition of William A. Stephenson of Lawrence Co., Tenn. My mother Rosanna Stephenson died 22 May 1849 but she did not purchase the 20 acre tract of land from me. I agreed to give my mother a title bond for the land about two years before she died but was to give her a deed when the purchase money was paid. Not being able to pay but $50 back Rosanna asked me to let Daniel Richardson have the 20 acre tract and I took a note of said Daniel for $160. After Rosanna's death, Daniel came to me and asked me to take the land back as he had not been able to pay for it. It is not true that Rosanna paid him $200 for the land. She was old and childish and I think Rosanna Blanks and Daniel Richardson persuaded her to make a deed to them for the land was never given a deed by my mother and never gave her a deed for the land. She never owned the land.

I Rosannah D. Stephenson of the County of Maury & State of Tennessee of sound memory & discriminant mind do make disdain(?) & ordain this to be my last will & testament. I give & bequeath to my daughter Thomas F. Childress fifty dollars. To my son James G. Stephenson I give & bequeath my carry all. To son William A. Stephenson I have already given fifty dollars which i deem his sufficient portion of my property. To my son John G. Stephenson I have already fivent fifty dollars which is his full portion of my property. To the children of my daughter Mary A. Note: According to James Madison Patton (her oldest son), Samuel Boyd Patton had 17 children. Three of the children were by a second marriage. Sarah and Samuel would then have had 14 children, 7 of whom are known at present. According to the 1830 census for Walker County, Alabama, Sarah was probably deceased, as there was no female old enough to be Samuel's wife. My best guess is that she died in Alabama.

Notes for Samuel Boyd PATTON
On November 8, 1813 Samuel B. Patton was a Captain of a Volunteer Rifle Company attached to the 47th regiment of the Tennessee Militia. He fought against the British.

Samuel Boyd Patton served as the President of the Board of Land Commissioners for the County of Bastrop. In 1837 he was appointed as assessor for private property.

Know all men by these presents that We S. B. Patton, Edward Burleson, James Smith, Thomas Kenney, William Cannon and Samuel R. Miller, are held and firmly bound unto Samuel Houston President of the Republic and his successors in office in the sum of Twenty thousand dollars, for the due payment whereof we bind ourselves our heirs, executors and administrators jointly and severally, firmly by these presents sealed with our seal and dated this fourteenth day of January 1838. The consideration of the above obligation is such that whereas the above be and S. B. Patton has been duly elected and appointed President of the Board of Land Commissioners in and for the County of Bastrop, as also receives of Public Monies in the Land Office of said County, now if the said S. B. Patton shall well and truly discharge the duties of said appointment, and shall faithfully pay over to the Secretary of the Treasury all sums which may come into his hands on account of public lands, then this obligation to be void, else to remain in full force and effect, Witness our hand and seals.

Moses Gage Edward Burleson (Seal)

He was on Bastrop County's first jury. He donated 100 acres of land to the Republic of Texas to have the seat of government located in the town of Bastrop. On 21 Oct 1837 was appointed secretary of a commission to make Bastrop County appealing to Congress as a capital. He was also in the 4th Congress for the County of Bastrop, in the Texas House of Representative 1839-1840. He was a Judge and Justice of the Peace for Kendall Co., Texas before he died.

He came to Texas in 1836 and took out his citizenship in Bastrop Co., Texas.

Record of the County of Mina 1837, pg 142:

Republic of Texas, County of Mina| I do hereby certify that Samuel B. Patton appeared before me and having proved to my satisfaction that he has resided six months in this Republic, has taken the oath required by the Constitution to entitle him to all the rights and privileges of Citizenship this 4th Sept 1837. Recorded 13th Sept 1837. A. Rabb C.J.C.(?) Wm Gorham Recorder.

He is buried on the Lutz farm on Curry's Creek just outside Kendalia, Texas. His grave is out in the middle of a field, under a big oak tree, maybe 50 yards from the creek. The grave has a wrought iron fence around it to keep the animals out. A regular stone marker now is at the head of the grave. An historical marker has been erected by the Historical Society of Texas. When I first saw the grave it had a big wood fence around it. I have pictures of the grave with my daughter Deborah, taken in 1979. The original marker that I saw had the dates of born August 15, 1784 died 19 March 1869. James Madison Patton's bible record says born August 15, 1787 and died 20 March 1869. I am suggesting that James Madison Patton when notified of his fathers death, wrote the date that he received the news. I believe that the original tombstone is correct.

Samuel went to Davidson County, Tennessee in 1809 married Sarah D. Stephenson. After their marriage they lived to Williamson County, Tennessee where a number of their children were born. Again, according to
James Madison Patton, Samuel had 17 children, however, the 1830 census of Walker Co., AL does not reflect that. James Madison Patton being the eldest son was 19 at the time of the 1830 census and it shows him as the only son that age. Also, the 1830 census shows 8 children born up to 1830. Three children were born to Samuel and Elizabeth. Samuel's wives that have been documented are: Sarah D. Stephenson and Mrs. Elizabeth Dease. The Samuel Patton who married Nancy Morrison was a "Single man" in 1823. This Samuel has been identified as being our Samuel Boyd, but so far the evidence proves otherwise. There may have been two Samuel Patton's. Sarah Matilda Patton's family history (she was born in 1826), states that she was the "daughter of Samuel B. Patton and his first wife." That let's the Samuel Patton/Nancy Morrison hanging for now. More investigation needs to be done in Alabama.

The 1830 Walker Co., AL census pg. 263 reads: Samuel B. Patton 0 M U/5, 1 M 5-10, 1 M 20-15, 1 M 15-20, 1 M 20-30, 0 M 30-40, 1 M 40-50 -- 0 F U/5, 1 F 5-10, 0 F 10-15, 2 F 15-20, 1 F 20-30. (The female between 5-10, is probably Sarah Matilda, although she would only be 4 years old.)

In 1816, Samuel and Sarah move to the Walker County, Alabama area. It appears that he settled in Jefferson Co. first. In 1821, Pickens Patton was born in Jonesboro, Alabama (Jonesboro no longer exists. It is now known as Birmingham, Alabama). According to the land records, he got 2 grants in Walker Co. in 1825, which may have been when he moved there. He became representative to the legislature for Walker Co., AL in 1834.

At the end of 1836 he travels to Texas where he is found on the records of Mina County, Texas (under Spanish rule). James Madison's family indicates that J.M. arrived just days after the Battle of the San Jacinto (cannot be documented). Samuel, James Madison, I. P. Patton, and Thomas J. Patton take out their citizenship to the Republic of Texas under President Sam Houston in Bastrop County, Texas.

Samuel served as the President of the Board of Land Commissioners for the
State of Texas. He and James Madison received land grants to Red River County.

He was in the 4th Legislature for the State of Texas in 1839. He was a Judge and Justice of the Peace for Kendall Co., Texas before he died.

Obituary from the San Antonio Daily Herald, April 3, 1869, p. 2., c. 4:

JUDGE S. B. PATTON. -- It becomes my sad duty to inform you of the death of our venerable father Judge S. B. Patton. He died on the 30th, just at 10 o'clock, a.m. at his old residence on Curry's Creek, Kendall County, in the 82nd year of his age. He was a native of South Carolina -- was raised an orphan, without any facilities in the way of education.

All that he possessed of business qualifications was derived from his own exertions and a mind richly endowed by the hand of his creator. At the age of fifteen years he removed to Tennessee, there he grew to manhood and married. In 1812 he commanded a company of riflemen in the last war with Great Britian.

In 1816 he removed to Alabama, where he served for some time as Clerk of the County Court, and where he was returned a member to the State Legislature for three consecutive terms.

Having lost his first wife, he married a second time, and became the father of seventeen children. In 1837, he emigrated to Texas, where he was appointed President of a Board of commissioners to transact business of vital importance to the State, and was afterwards a member of the first Congress of the Republic of Texas. The last office he filled was that of Chief Justice of Blanco County. It is not necessary for me to say that he invariably discharged the duties confided to his trust with credit to himself and the entire satisfaction of his constituents...

Samuel B. Patton, Legislator, 1834

In 1833 Walker County was granted representation in the legislature and Samuel B. Patton was elected the first represntative for the county, serving during the sessions of 1834 and 1835. Very little is known of Samuel B. Patton, other than that he came into the county in 1824 and entered government land at two points on the Warrior River, one near Heard Shoals and the other near Snow Ferry.

Missouri is the daughter of Hiram M. Estes and Lucy Richardson. About
1835 Hiram and Lucy Estes moved to Newton County, Missouri where they
remained until 1843. They then removed to Bowie County, Texas where
Missouri met and married Pickens Patton.

After the death of her mother in July 1845, Pickens and Missouri moved
to Hays County, Texas.

Missouri's grandson Jesse Patton (now deceased), from Kerrville,
Texas, said that his grandmother was Cherokee Indian. Several
grandchildren said that their grandmother was Cherokee Indian. The
migration of the Estes and Richardson families from Virginia to Texas
appear to bare out the story, however, there are no official Indian
rolls that have the family on them. The history shows that they
missed being placed on the rolls because of them moving or because of
death prior to the rolls being taken.

She is said to have smoked a corn cob pipe and played the fidle.

She is buried in a small cemetery on a farm on the Upper Ciebilo Creek
near Boerne, Texas. The cemetery is also the resting place of Charles
Benjamin Patton (son).

The family in Boerne, Texas states that he is buried beside his mother out on the old upper Cieblo Road. I have seen the cemetery, but there are no headstones for either Charles Patton or Missouri Estes.

I was born Robert Howard Harper, February 17, 1910 at Richland Oregon, formerly called Eagle Valley; to parents Edward Hiram Harper and Anna Lee Kimbrough.

My Parents was living and working in the only Hotel there, my Father was a stagecoach driver and frieght hauler for supplies to the various mining camps and to rancers in that area.

I had an older brother John William Harper born at Boise Idaho 31 Oct 1907, who died in 1924 at Olympia Wash. and a Sister born Ida Anna Harper in the Yakima Washington area on May 26, 1913 and at present living in Aptos California.

My father had started a fruit orchard near there and that is my first recollection of life, living in an apple orchard and some of the things that happened to me.

The youngest of the Family was Hilton Henry Harper born 14 Mar 1924 at Olympia Washington, then we moved north of Olympia to a farm, and my brother died there in 1924, at Olympia Hospital, and was buried in the Tumwater cemetary.

Later that year my parents separated and my mother left for California with my Brother and Sister, and they were divorced several years later, I was supposed to meet my mother in Portland Oregon the next day, as to save money I was going to hitch hike to Portland with a friend, but we had a bad time getting there and had to catch an old river boat that was a paddle steamer, and by the time we arrived in Portland my mother had left, so I went to my Grandfathers Calloway Harpers and found my father there.

In 1925 I contacted a man leaving Portland for California in an old touring car, as we arrieved in Santa Barbara Cal. we were welcomed by a devastating earthquake that shook the brick buildings into the streets. I arrived where my mother was living with my Grandfather William Lucien Pierce Kimbrough, at Inglewood Cal. I went to school in Inglewood until I was old enough to work.

In 1928 I met and became friends with Albert H. Webb, he was involved with Hawaiian music as he had lived in the Islands for several years and he taught me the guitar and formed a trio; we played at some radio stations and clubs for a while.

My Granfather William Kimbrough passed away in 1932 and my mother and I and my Brother Hilton went to Rye Valley Oregon to visit her sister Mary Missouri Kimbrough Justus, she had 7 children and 5 at home they lived on a cattle and sheep ranch, we stayed with them a couple of years, while there I contacted spotted tick fever and come close to dying. After that we came back to California to Bell Gardens in time for the Long Beach earthquake.

Times were very hard during the depression, but we survived. In 1937 I was working on the Metropolitan Water aqueduct at Parker Arizona, and when in 1938 I came to Los Angeles to see my Mother who had moved there to an apartment I met my wife Martha Thelma Hobbs and we were married later that year November 8, 1938, she had been visiting her sister that was living at the same apartment.

We had three children, Li Ann was the 1st born, at the Hollywood Hospital, then we went to Pendleton Oregon job hunting thru some friends that had moved there and went to work for the Union Pacific R.R. then later moved to Salt Lake City in 1940 where our 2nd child Dawn Laraine was born 25 Oct 41.

The war was very involved in everyones lives, military industries moved into Salt Lake creating critical housing shortages, our rented house was sold out from under us and no place to go so we bought a used truck and moved back to Los Angeles along with my wife's mother Cora Hobbs and her little niece Violet Hendricks.

We finally settled in San Gabriel Cal. where our son Richard Darrel Harper was born on 16 Feb 46 in the St. Luke Hospital at Altadena California.

We then moved to Redlands California to escape the smog which was becoming very bad in our area. We had good friends living in Redlands but after several years of poor times, I went to work for the California State highways, and after 20 years I retired and moved to Cherry Valley, in 1974.

I was Baptized into the Church of Jesus Christ of Latter-day Saints in 1952, and was fairly active for a few years. My wife Martha and I were married in the Idaho Falls Temple 11 July 60, our Son Richard was sealed to us at that time, as our Daughters had left home and was married, Li Ann was sealed to us later in the Los Angeles Temple.

We are still living in the Cherry Valley and very active in our church work having been Ward Clerk, High Priest Group Leader, and Executive Secretary to the Bishop.

Richard Darrell Harper, 53, died Saturday at Braswell's Hampton Manor in Yucaipa.

Harper, a native of Altadena, lived in Yucaipa for four years.

He held various jobs throughout the years.

Survivors included his son, Cody Eric of Calimesa; his daughter, Wendy Rene Drysdale of Calimesa; his father, Robert of Twin Falls, Idaho; his sisters, Li Anne Lee of Twin Falls, and Dawn Lamar of Denver; and six grandchildren.

Visitation and services will be 4 to 7 p.m. today at Aaron Chapel, 24684 Barton Road, Loma Linda. Inurnment will be private.

BURIAL: He was cremated and his ashes are be interred at Desert Lawn in Calimesa, California.
